Charges dismissed against Walt Kyle

MARQUETTE — Charges of residential mortgage fraud and forgery of a document affecting real property against former Northern Michigan University hockey coach Walt Kyle have been dropped.

Marquette County Prosecuting Attorney Matt Wiese announced his decision to dismiss the charges today, stating that additional evidence has been presented after the charges were authorized last month.

Kyle, of Marquette, was arrested on the two felony charges on March 10 following, an 11-month investigation, according to the Marquette County Sheriff’s Office. It was alleged he had committed fraud and forgery while obtaining a mortgage with River Valley Bank in December 2014.

Wiese said evidence presented after the charges were authorized revealed that “most, if not all, of the money that was obtained by Mr. Kyle through this loan was used to pay off existing debt accumulated during the marriage to his former spouse.”

Prior to reviewing this evidence, it was believed that the loan money was unaccounted for, and that “Mr. Kyle may have disposed of it for his own personal use.”

Wiese also said that Kyle had signed his former spouse’s name on documents to secure the mortgage loan. The woman reportedly hired an attorney to have the bank remove her signature from the documentation.

“Mr Kyle has agreed that he will reimburse his former spouse for the costs of that attorney,” the release, signed by Wiese, reads. “It appears that the money was used to pay off debts incurred during the marriage, and because Mr. Kyle has agreed to reimburse his former spouse for the expenses associated with removing her name from the bank records, I do not believe it is in the interests of justice to continue to prosecute this case.”

NMU officials in March announced that it would not renew Kyle’s contract.

The Mining Journal did not identify Kyle in it’s original coverage of the incident, as it is against the newspaper’s policy to publish an individual’s name before arraignment.

Kyle was scheduled to be arraigned in the Marquette County District Court Monday.
