Havican, attorney nix plea offer

MARQUETTE — A former UP Health System-Marquette employee arrested on a 14-count felony warrant in 2022 has withdrawn from a plea deal revised by a judge.

The defendant, 27-year-old Jarod Havican of Marquette, and his attorney George Hyde III appeared before Judge Andrew Griffin on Thursday for a sentencing hearing.

Havican took a week to consider a revised plea deal handed down by Griffin on Dec. 27.

The judge offered the defendant six months in jail, and 18 months probation instead of the previous deal agreed upon by Hyde and the prosecutor, which would have sentenced him to five months in jail and 12 months probation.

Havican was charged with 14 felony counts after police say he hid a camera in the UP HS – Marquette bathroom in December 2022.

The warrant included seven counts of using a computer to commit a crime and seven counts of capturing-distributing images of an unclothed person.

If the defense had agreed to the plea deal conditions set forth by Griffin, Havican would have plead guilty to one count of using computers to commit a crime.

UPHS-Marquette fired Havican immediately after charges were filed.

Havican’s plea-deal withdrawal resulted in a recess. According to case details obtained from the MI Court website, the next hearing — a scheduling conference — is set before Griffin at 11:30 a.m. on Jan. 16.

Havican is free on a $1,000 personal recognizance bond.

According to Hyde, the defendant spent all of 2023 living with his parents under strict rules that forbid him from using devices connected to the internet, computers or cameras.
