MARQUETTE — The city of Marquette has reached a compromise with local developer who built two homes too close to the street last year. The city has agreed to vacate sufficient right-of-way for zoning compliance while charging the builder $3,050 to cover the city’s administrative and legal costs. The two homes were built in the Bartelli Subdivision last year, Setback problems were discovered in January. “I’m real happy with it,” the builder said of the agreement. “I think it’s something that will work for everyone. I can sell my homes now.” The homes are 10 and 11 feet from the front lot line. City setbacks require their front eaves to be at least 20 feet from the property line. The builder contended the ordinance was different than in other areas in which he’s built homes, saying he didn’t know he wasn’t measuring back far enough. He measured 30 feet from the curb to front of the house, failing to allow for the city’s 18-foot right-of-way. City commissioners said Monday that they’re happy with the compromise.
