MENOMINEE -- A Wallace man with a lengthy criminal record was sentenced to 2 years, 7 months in state prison for operating while intoxicated, third (or subsequent) offense and as a habitual offender, second offense.
In an announcement by Menominee County Prosecutor Jeffrey T. Rogg, David Howard Lemery, 46, received the prison sentence from 41st Circuit Court Judge Christopher S. Ninomiya, on Thursday.
"Mr. Lemery has established himself as a proven, lifetime criminal, with six prior felony convictions and six prior misdemeanor convictions since 1998 including five prior OWI convictions through the state of Wisconsin and two prior in the state of Michigan," said Rogg in a written statement. "His utter lack of remorse was borne out at his sentencing, when he denied to Judge Ninomiya that he was an alcoholic."
According to publicly-filed documents and information presented in open court, on Dec. 7, 2025, officers from the Menominee Police Department observed a vehicle traveling northbound on First Street near Tenth Avenue with an abnormally loud exhaust.
The vehicle operator was identified as Lemery, who, at that time, admitted that he did not possess a driver's license. Lemery admitted to police that he had been drinking and was impaired. A THC vape device was found in Lemery's pocket. A forensic analysis of Lemery's blood showed a .181 BAC and the presence of THC.
Ninomiya had these words for Lemery: "Habitual drunk driving is not simply a traffic offense. It is a continuing threat to society."
