MARQUETTE -- Following last week's mistrial in the Julie Boxley trial, in which the jury split 7-5, Chief Public Defender Patrick Crowley is seeking to have Boxley's bail reduced or removed.
Boxley was charged with one count of felony murder and one count of 1st degree arson, and was accused of intentionally setting fire to the Ishpeming home she lived in with Glenn Andrews. Andrews later died of injuries he sustained as a result of the fire.
The bond hearing is set for 8:15 a.m. on Sept. 10 and Crowley will attempt to convince Circuit Judge Andrew Griffin that Boxley does not pose a threat to the community.
"Given that the state is unable to show that a fire was intentionally started, or that it was intentionally started by Julie, I think any potential risk to the community has been shown to not exist," said Crowley. "… There's no evidence that she started a fire. And if there's no evidence that she started a fire, it's hard to believe that she's a threat to the community.
"Therefore, I think bond is appropriate. Certainly a reduction is appropriate, and a personal recognizance is also appropriate, in our opinion."
Boxley's bail is currently set at $10 million for each charge, for a total of $20 million. She has been incarcerated for approximately three years awaiting trial.
