MARQUETTE — The Marquette County Board held a special meeting on Friday, with an agenda item of “Termination of Contract with Kubick Aviation Services, Inc. for Non-Payment & Contract Default.”

During this session, the county’s civil council, Alex Berger, stated that “we recently received a letter regarding the pending litigation and I believe we should have a closed session early on under MCL15.2681E.”

“This is under MCL15.2681E, which reads ‘to consult with its attorney regarding trial or settlement strategy in connection with specific pending litigation but only if an open meeting would have a detrimental financial effect on the litigation or settlement position of the public body,'” said Berger.

The commission voted to add a closed session to the agenda.

During public comment, Chief Operating Officer of Kubick Aviation Jordanne Schwandt said “I just want to take the opportunity to thank you for going into closed session and reviewing the document that was provided to your civil council from our council. I think it’s important that the county review all of the facts as they may be and just state that we, Kubick Aviation, have been committed to a good relationship with the county of Marquette, and we hope to continue that partnership.”

The commission then went into closed session. After the closed session, the commission moved to the agenda item “Termination of Contract with Kubick Aviation Services, Inc. for Non-Payment & Contract Default.”

“I would actually make a motion to have no action on that item, but to have a special meeting on Tuesday, April 28, 2026 to consider the documents and other information concerning Kubick, our current FBO,” said Vice-Chair Bill Nordeen.

On Monday afternoon, Marquette County sent out a notice that a special meeting would be held Tuesday at 6 p.m. However, several hours later another email was sent by the county canceling that meeting, with the stated reasoning “upon civil council review of court documents.”

The lawsuit between Kubick Aviation and Marquette County was filed in relation to the county terminating their FBO contract with Marquette Sawyer Regional Airport back in October.
