MARQUETTE -- Kevin Thomas Kelly entered a plea of no contest for discharging a firearm -- while his charges of assault with intent to murder and felony firearms were dismissed -- on Tuesday in the 25th Circuit Court, according to court officials.
The charges stemmed from an Oct. 13 incident in which the Michigan State Police said Kelly brandished a gun at police. Kelly was shot by a Michigan State Police trooper who responded to the incident at a residence along the 100 block of Crusader Street at K.I. Sawyer.
Officers from the Forsyth Township Police Department and the Marquette County Sheriff's Office first responded to the residence for a well-being check. The officers tried to communicate with Kelly, who police said brandished a gun and fired a shot through a window and in the officers' direction.
The Michigan State Police Emergency Support Team, whose assistance was requested, then verbally commanded Kelly to put down his weapon. However, he refused and fired several more shots inside and in the direction of police outside the home, police said.
While troopers again tried to communicate with him, Kelly came outside with a long gun and, attempting to point the weapon at police, was struck by a shot fired by an MSP trooper, according to a previous Journal article.
Kelly is scheduled to be sentenced on Dec. 11 in Marquette County Circuit Court.
