MARQUETTE — Proposal 1, the Marijuana Legalization Initiative, is a voter-initiated proposal that would “authorize and legalize possession, use and cultivation of marijuana products by individuals who are at least 21 years of age and older, and commercial sales of marijuana through state-licensed retailers,” according to ballot information.
Voters will head to the polls Tuesday to decide if the proposal will become law. A “no” vote indicates opposition to the proposal, while a “yes” vote indicates support of the proposal. A simple majority is needed for the proposal to pass.
Voter-initiated laws, such as Proposal 1, change the state law and go into effect 10 days after the vote, if passed. A voter-initiated law can be overturned with approval from three-fourths of the lawmakers in both houses of the Legislature.
If passed, the law would allow people to grow up to 12 marijuana plants for personal consumption; impose a 10-ounce limit for marijuana kept at private residences and require amounts over 2.5 ounces to be held in locked containers; permit sales of marijuana and edibles, subject to a 10 percent tax; create a state licensing system for marijuana businesses and allow municipalities to ban or restrict them; and change several current violations from crimes to civil infractions, according to the ballot proposal.
Revenue from the tax collected would be allocated to local governments, K-12 education, and road and bridge maintenance, according to the ballot proposal.
