Trial set in Iron County worker death
CRYSTALS FALLS — An Argonne, Wis., man accused of fatally striking an Iron County Road Commission worker with his vehicle on Bates-Amasa Road in January is set for a three-day jury trial in January 2022.
Jerry Mittelstadt, 57, rejected a plea offer at a pretrial conference Monday in Iron County Trial Court.
Mittelstadt is charged with a moving violation causing death in a work or school bus zone and/or in the alternative reckless driving causing death, both felonies punishable by up to 15 years in prison.
Mittelstadt is charged as a three-time habitual offender and could serve up to 30 years in prison if convicted.
According to the criminal complaint, the incident occurred in Crystal Falls Township on Jan. 13.
Earlier news releases stated Mittelstadt — who was unnamed at the time — failed to stop his pickup truck in a marked work zone on Bates-Amasa Road and hit 56-year-old Larry Leonarduzzi as he worked as a flagger near Shady Lane.
Leonarduzzi was pinned between Mittelstadt’s vehicle and an Iron County Road Commission vehicle and died on site, according to reports. He had worked at the road commission for more than seven years, Doug Tomasoski, an engineer-manager for the commission, said in January.
Trial is set to begin Jan. 25. A supplemental pretrial is set for Dec. 13.
