Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the circuit court in Marquette County, starting promptly at 10:00 AM, on June 29, 2023. The amount due on the mortgage may be greater on the day of sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. COMPLAINT

NOW COMES the Plaintiff, EMBERS CREDIT UNION, a Michigan Corporation, by and through its attorney, F. GREGORY MURPHY, and for its complaint says as follows:

1. That the Plaintiff is a Michigan Corporation doing business in the County of Marquette, Michigan.

2. That the Defendant, Brian Hill, is a resident of the County of Marquette, Michigan.

3. That the causes of action herein stated arose within the County of Marquette, Michigan.

COUNT I

CREDIT CARD

ACCOUNT

4. The Plaintiff realleges and incorporates, by reference, herein the allegations contained in paragraphs 1 through 3.

5. That on or about January 20, 2021, the Plaintiff approved the Defendants application for a consumer credit card account with a $500.00 limit. A copy of said application is attached hereto as Exhibit A.

6. That pursuant to the terms and conditions of said credit card account, the Defendant was to repay the obligation by consecutive monthly payments.

7. That the Defendant failed to make the monthly payments when due and there is now a delinquency on said account in the amount of $178.20.

8. That the balance on said account is $678.20.

9. That despite repeated requests by Plaintiff, the Defendant has failed, refused and neglected, and continues to fail, refuse and neglect to satisfy said obligation.

COUNT II

SECURED LOAN

10. The Plaintiff realleges and incorporates, by reference, herein the allegations contained in paragraphs 1 through 9.

11. That on or about July 15, 2021, for valuable consideration, the Defendant, executed a promissory note in favor of the Plaintiff in the amount of $7,687.09. A copy of said note is attached hereto as Exhibit B.

12. That said promissory note is secured by a 2014 Dodge RAM 2500, vin# 3D7KU28C34G21474 0.

13. That said motor vehicle is an independent piece of property with little or no value.

14. That pursuant to the terms and conditions of said promissory note, the Defendant was to repay the obligation by consecutive monthly payments of $268.40.

15. That the Defendant has failed to make the monthly payments as they became due and the account is now delinquent in the amount of $2,222.93.

16. That the balance on said account of $5,841.98. remains due and owing.

17. That despite repeated requests by Plaintiff, the Defendant has failed, refused and neglected, and continues to fail, refuse and neglect to satisfy said obligation.

COUNT III

SECURED LOAN

18. The Plaintiff realleges and incorporates, by reference, herein the allegations contained in paragraphs 1 through 17.

19. That on or about October 15, 2021, the Defendant executed a promissory note in favor of the Plaintiff in the amount of $9,500.00. A copy of said note is attached hereto as Exhibit C

20. That said promissory note is secured by a 1979 Gafner Iron Mule, vin# A810331A.

21. That said vehicle is an independent piece of property with little or no value.

22. That pursuant to the terms and conditions of said promissory note, the Defendant was to repay the obligation by consecutive monthly payments of $201.44.

23. That the Defendant has failed to make the monthly payments as they became due and the account is now delinquent in the amount of $1,408.33.

24. That the balance on said account of $8,619.61 remains due and owing.

25. That despite repeated requests by Plaintiff, the Defendant has failed, refused and neglected, and continues to fail, refuse and neglect to satisfy said obligation.

WHEREFORE, Plaintiff prays that it be awarded judgment against the Defendant, Brian Hill in the amount of Fifteen Thousand One Hundred Thirty-nine and 79/100 ($15,139.79) Dollars, together with interest, costs and attorney fees wrongfully incurred.
