Upon consideration of the motion of Plaintiffs, attesting to the fact that the Defendants, cannot be personally served with a Summons and a copy of the Complaint herein because their present whereabouts are unknown, and they have no last known addresses, and that publication of notice of this action in a newspaper of general circulation is most likely to give notice to these Defendants, and it appearing to this Court that Plaintiffs, after diligent inquiry, have been unable to ascertain the Defendants’ residences either within or without the State of Michigan and it further appearing that personal service of the Summons and Complaint in this action cannot be made on the Defendants, with the exception of Bryan Urquhart for the above states reasons, and that publication is the best means available to apprise Defendants of the pendency of this action.
IT IS HEREBY ORDERED that the Defendants, Peoples CO-Operative Park Association of Rock, Michigan, and John Urquhart and Arlene L. Urquhart, and their unknown heirs, successors, agents, directors, officers, and assigns, shall on or before the 28th day of after the last date of publication, serve their answer on F. Gregory Murphy, Attorney for Plaintiff, whose address is 419 W. Washington Street, Marquette, Michigan, 49855, or take such other action as may be permitted by law. Failure to comply with this Order may result in a judgment by default against said Defendants for the relief demanded in the Complaint filed in this Court.
IT IS FURTHER ORDERED that a copy of this Order be published once each week for three consecutive weeks in the Mining Journal, a newspaper of general circulation hereby designated as most likely to give notice to the Defendants. Publication shall occur within the County of Marquette, State of Michigan.
IT IS FURTHER ORDERED that the first publication of this Order be made within fourteen (14) days from the date of entry of this Order; and that mailing a copy of this Order be dispensed with because Plaintiff cannot, with reasonable diligence, ascertain a place where the Defendants would probably receive matter transmitted by mail.
