A Marquette police investigation revealed both men were in the company of Kyle Dowling, 22, on the night of his death. Dowling was found on the porch of his Lynn Street house Oct. 1, 2013.

Police said the men failed to summon medical assistance for Dowling, who was in obvious medical distress, and failed to report his death to the authorities.
