MARQUETTE - A 28-year-old Marquette man faces an unusual penalty of between one day to life in prison after allegedly exposing himself to two women on the bike path in Marquette Monday afternoon.
The Mining Journal is not publishing the man's name until his arraignment in Marquette County District Court, which is scheduled to take place at 8:15 a.m. Monday.
According to the Marquette City Police Department, officers were called to the area of the bike path near the Upper Peninsula Medical Center, located along West Fair Avenue, at approximately 3:15 p.m. Monday on report of a male subject exposing himself to women.
Upon arrival, police spoke with a female subject who stated she was walking down the bike path between Fair Avenue and Wright Street when she saw a male subject walking out of the woods.
The woman said the suspect was exposing himself and she rapidly left the area.
The woman said there was another woman on the bike path at the time of the incident. She also provided a description of the alleged flasher, which officers used to successfully locate the suspect hiding in a garage off of West Avenue.
Police said the suspect said he was there to do landscaping work but found that not to be true after speaking with the property owners.
Police said the two women from the bike path were taken to where the suspect was detained, where they positively identified him as the man they saw exposing himself.
Police said the suspect had recently moved to the area from Texas and alleged he was responsible for other indecent exposure incidents this summer reported to have happened in the same area.
The man was arrested and lodged at Marquette County Jail, charged with two counts of indecent exposure by a sexually delinquent person.
Michigan law defines a "sexually delinquent person" as "any person whose sexual behavior is characterized by repetitive or compulsive acts which indicate a disregard of consequences or the recognized rights of others."
Indecent exposure by a sexually delinquent person carries a penalty of between one day and life in prison.
The charge of indecent exposure - depending on the act - carries a one- or two-year maximum prison sentence.
According to the Marquette County Sheriff's Office, the man was held on 10 percent of $2,500 for each of the two charges brought against him.
He posted bond and was released.
